1. Introduction
1.1 These Terms and Conditions govern the relationship between you (“the Student”) and Kensington Institute (“the Institute”) upon enrolment in any course or programme offered by the Institute.
1.2 By enrolling in a course, you agree to abide by these Terms and Conditions, the Student Code of Conduct, Privacy Policy, and all other published policies and regulations.
1.3 These Terms and Conditions are subject to review and may be amended from time to time. Any updates will be communicated to students via email and the official website.
2. Student Responsibilities
2.1 By registering with the Institute, you agree to:
Provide accurate and truthful information during the application and enrolment process.
Pay tuition fees as per the agreed fee payment plan.
Submit assessments and complete coursework on time.
Comply with academic and conduct policies.
Maintain communication with academic and support staff as required.
2.2 If you were previously excluded from any educational institution, particularly due to misconduct, you must disclose this. Failure to do so may result in cancellation of your enrolment.
2.3 Any criminal convictions must be disclosed during application. Decisions regarding enrolment will be made based on safeguarding policies, and may result in withdrawal of offers.
3. Course Delivery and Content
3.1 All courses are delivered online. Students are responsible for ensuring they have access to a stable internet connection and compatible device(s).
3.2 The Institute reserves the right to make reasonable adjustments to course content, delivery methods, tutors, and schedules without prior notice.
3.3 While every effort is made to ensure accuracy, course descriptions and learning outcomes are subject to change in line with academic development and standards.
4. Course Fees and Payment
4.1 Full course fees are published on our website. Any promotional offers or scholarships must be claimed and approved before enrolment.
4.2 Payment may be made in full or via an agreed instalment plan. Failure to adhere to the payment plan may result in access restrictions or termination of your place.
4.3 All fees are quoted in GBP (£) and are exclusive of additional costs such as examination, certification, or awarding body registration fees, unless explicitly stated.
5. Cancellations and Refunds
5.1 Distance Learning Cancellation Rights
In accordance with the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you have 14 days from the date of enrolment to cancel your course and receive a full refund, provided the course has not started.
If the course has begun within the cancellation period, a partial refund will be given proportionate to the course delivered.
After 14 days, our standard refund policy applies.
5.2 Withdrawals and Refunds
Withdrawal before course start date: 90% refund (10% admin fee).
Withdrawal within two weeks of start date: 50% refund.
Withdrawal after two weeks: No refund.
Withdrawal from short courses (9 months or less): No refund.
Instalment-based enrolments: No refund at any point.
5.3 Course Cancellation or Rescheduling
If a course is cancelled or rescheduled by the Institute and no alternative is suitable, a full refund will be issued.
5.4 Illness or Extenuating Circumstances
Refunds/credits may be granted if a permanent medical condition prevents completion of the course (supporting evidence required).
Temporary illness may qualify for credit (valid for 24 months), but not a refund.
Absences due to work, personal or financial issues do not qualify for a refund.
5.5 Student Misconduct or Policy Breach
No refund will be issued if a student is withdrawn for breaching academic, conduct, or attendance policies.
5.6 Quality Concerns
Students should first raise issues with the tutor. If unresolved, a formal complaint may be submitted. Refunds for quality issues are at the Institute’s sole discretion.
6. International Students
Visa refusal: All fees (less a £250 admin fee) refunded upon submission of original visa refusal and enrolment documents.
Students entering the UK on a visa issued through the Institute are not entitled to refunds post-arrival.
Visa extension withdrawals: No refund provided.
Instalment-based international students: No refund under any circumstances.
7. Fee Recovery and Debt Collection
7.1 The Institute reserves the right to take appropriate measures to recover unpaid fees. This includes:
Issuing reminders and final notices.
Involving third-party debt collection agencies.
Adding collection charges to outstanding balances.
Initiating civil court proceedings if necessary.
7.2 Students facing financial difficulties should contact the Finance Team promptly to explore support or modified arrangements.
8. Use of Personal Data
8.1 We process personal data in accordance with the UK GDPR and Data Protection Act 2018.
8.2 Data may be shared with partners such as awarding bodies or financial service providers for course administration. No data will be sold or used for marketing without your consent.
9. Intellectual Property
9.1 All course content, materials, videos, and digital assets are the property of Kensington Institute or licensed third parties and may not be copied, distributed, or modified without written permission.
10. Termination of Enrolment
10.1 Enrolment may be terminated by the Institute if:
You fail to meet payment obligations.
You breach conduct or academic policies.
You provide false or misleading information.
You engage in activity that brings the Institute into disrepute.
11. Complaints and Appeals
11.1 Students can raise complaints formally through our Complaints Procedure. Appeals against academic or disciplinary decisions must follow the published Appeals Procedure.
12. Governing Law
12.1 These Terms and Conditions are governed by and interpreted in accordance with the laws of England and Wales.
12.2 Any disputes will be subject to the jurisdiction of the courts of England and Wales.
